The case-in-chief is S&P Consulting Engineers v. Baker et.al., Texas Court of Appeals, 2011. Among other restrictions that the various states have imposed on expert witness testimony, especially out-of-state experts, several states now require a ‘certificate of merit’ before one may proceed with a negligence lawsuit against a professional service provider, like a surveyor or engineer. What is the ‘certificate of merit,’ how is it applied and does it otherwise negligent surveyor or engineer to escape from liability due to a technical filing error? This case explores all of those issues. This is a 2-Page Letter covering 1 Court Opinion consisting of 14 pages. This 16-Page document has a 10-Question examination based on the text of the newsletter and the case-in-chief with a focus on the expert witness testimony.
