The case-in-chief is Wilson v. Erickson, Washington Court of Appeals, 2022. As the story often goes, the Wilsons were living out the American Dream, in happy, peaceful co-existence with their neighbors to the east for about 20 years, until the visitation of the surveyor. In 2019 the Ericksons bought the property to the east of the Wilsons, commissioned a survey of their newly purchased property and trouble soon ensured. The survey revealed that two old-growth evergreen trees that the Wilsons believed to be on the common property line were not. One was completely on the Ericksons’ property and the other mostly so. After the survey results, Clayton Erickson informed Peggy Wilson that he intended to take them both down and that is when the stuff hit the fan.
