Expert Witness VI – 1.5 Contact Hours
The case-in-chief is Butler v. McCain and Associates, California Court of Appeals, 2016. When testifying in court, witnesses (any witness, expert of otherwise) enjoy a limited immunity or privilege to be free from reprisals through subsequent lawsuits over that witness’ testimony. This is often referred to as the ‘litigation privilege.’ In this case, it is also referred to as the ‘official proceedings privilege.’ Does the privilege extend to negligent surveying that subsequently becomes the catalyst for a boundary dispute lawsuit?
