The case-in-chief is Duane v. Saltaformaggio, Mississippi Supreme Court 1984. The question asked by this case is do after-erected monuments in a subdivision hold when they are in conflict with the subdivision plat? Framed another way, can an original subdividing surveyor blunder or are the monuments placed by the original surveyor sacrosanct?
