Government Surveys I – 1.5 Contact Hours
The case-in-chief, State of Florida v. Toffel, Florida Court of Appeals 1962, involves a Dependent Resurvey and Extension Survey performed by the U.S. General Land Office (GLO) in 1939 to reclaim supposed omitted lands that were not included in the Original Surveys performed by the GLO in 1850 and 1882. As a result of the Dependent Resurvey, lands that Toffel had purchased from the State of Florida were confiscated by the federal government and then patented back to the State of Florida and the lawsuit ensued. Unfortunately, government confiscation of private property by survey, without either constitutionally mandated “due process” or “just compensation,” is not uncommon.
