The case-in-chief is Jackson v. Bownas, Tennessee Court of Appeals, 2005. As we research and review cases for new editions of The Lucas Letter, we often find cases where something went wrong for various and sundry reason. Meaning that had mistakes not been made, the outcome in the case could have gone the other way (or not occurred at all). Often it is the testimony of the surveyor experts, sometimes it is the attorneys working the case, it can be the judge trying the case, or even the appellate court decision that is the problem. This case involves a surveyor who, through successive surveys over three decades, assisted in moving a common boundary line to within 11 inches of a neighbor’s back door. We study the case to determine “what went wrong” and avoid the same pitfalls ourselves. This is a 2-Page Letter covering 1 Court Opinion consisting of 12 pages. This 14-Page document has a 10-Question examination based on the text of the newsletter and the attached case.
