The subject of this edition is Standards of Practice and the case of Checovich v. Cochran, Ohio Court of Appeals, 2018. We chose this case to study primarily because it was a follow-up to the case of Kennedy v. Rose, Ohio Court of Appeals 2008, that was the focus of the August 2011 Edition of TLL. Our Editor, Jeff Lucas, had previously written about the Kennedy case in his February 2009 column in POB Magazine and the incredible deference the Court of Appeals gave to the Ohio Standards of Practice. The unprecedented action in Kennedy was the Court of Appeals adoption of the Ohio Standards of Practice as the procedure for resolving boundary dispute cases. There are no other standards of practice in any jurisdiction with such status. How are the Ohio Standards of Practice holding up in this latest case?
