Evidence & Procedures VI – 1.5 Contact Hours
The case-in-chief, Beckham/Tillman v. Bennett, Florida Court of Appeals 2013, is a unique case in that it was tried exclusively on the depositions of the two land surveyors in the case and their respective survey maps. Therefore, when it went up on appeal, the only question before the court was which surveyor followed proper procedure, and the only evidence the court considered was the depositions and the maps. This case puts the student in the same position as the appellate court, considering the same exact evidence the court did. This is a 2-Page Letter covering 1 Court Opinion consisting of 3 pages. In addition to these documents, we have provided the “Plaintiff’s Written Argument and Memorandum of Law” (7 pages), and the depositions of the two surveyors and maps that were entered into evidence (another 77 pages). This 89-Page document has a 10-Question examination. Given the size of this edition of TLL, in order to limit the scope of the examination to 1.5 contact hours, the exam will cover the first 12 pages of the letter and questions may be asked with regard to the highlighted portions of the depositions. The remainder of the depositions and exhibits are for your personal enjoyment.
