The case-in-chief, Ex Parte Howell Engineering and Surveying, Alabama 2006, involves an employment contract and the issue of “moonlighting.” Damages in these types of cases can be substantial and, as this case clearly illustrates, can include punitive awards. This case also implicates the issue of the restraint on the lawful practice of a profession.
