The case-in-chief, Sellman v. Schaaf, Ohio Court of Appeals 1971, is a case involving platted lots in “Seminole Shores Subdivision No. 2,” the original survey of the subdivision and later notions as to the location of the common lot line between Lots 86 and 86. What happens when the original “stake” for the property line comes up missing and surveyors attempt to relocate the stake position utilizing measurements as opposed to the best available evidence? Parol evidence, the Rules of Construction and the Boundary Location doctrines all come into play. This is a 2-Page Letter, with an attached copy of the 1944 subdivision plat, covering 1 Court Opinion consisting of 15 pages with our added commentary. This 18-Page document has a 10-Question examination based on the text of the newsletter and the case-in-chief.
