The case-in-chief is Mullally v. Parks, Washington Supreme Court, 1948. As we research and review cases for new editions of The Lucas Letter, we often find cases where something went wrong for various and sundry reason. Meaning that had mistakes not been made, the outcome in the case could have gone the other way (or not occurred at all). This is one of those cases. In 1859 the General Land Office (GLO) survey of Fractional Lot 15 was made in the field and the SW Corner of Section 15 was in place. A subdivision was made 32 years later directly off the same SW Corner, however, as with the GLO surveys, not all of the lot corners were set. Then, 29 years later a survey was made off the same SW Corner and the old stakes of the subdivision to set out Lots 3 and 4 in Block 1 of the subdivision. Peace reigned in the neighborhood until another surveyor showed up in 1946 and moved the lots 20-25 feet north. What went wrong?
